1. Introduction

Welcome to Viya. By creating an account or using our ride-hailing application, you agree to be bound by these terms. If you do not agree, please refrain from using our services.

2. Use of the Service

Viya provides a technology platform that connects independent drivers ("Partners") with riders. Viya does not provide transportation services and is not a common carrier.

• Accounts: You must be at least 18 years old and provide accurate information to use the service.
• Prohibited Conduct: You agree not to use the service for illegal activities, harassment, or to cause nuisance to drivers or other users.

3. Payments and Billing

Viya uses Paystack as a secure third-party payment processor. By using the service, you authorize us to charge your credit or debit card for the total fare, including any applicable taxes and fees.

• Upfront Fares: Upfront fares are estimates based on current conditions. Final charges may vary due to route changes, extra stops, or traffic delays.
• Tipping: You may choose to tip your driver via the app. 100% of the tip goes to the driver.

4. Limitation of Liability

To the maximum extent permitted by South African law, Viya is not liable for indirect, incidental, or consequential damages arising out of or in connection with your use of the service.

Our total liability for any claim shall not exceed the amount of the ride fare associated with the claim.

5. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa.
